The Website is provided on behalf of Simon & Schuster (UK) Limited of Mitre House, 160 Aldersgate Street, London EC1A 4DD ("Simon & Schuster," "us" or "we"). Simon & Schuster Digital, a division of Simon & Schuster, Inc. of 1230 Avenue of the Americas, New York, NY, 10020 assists Simon & Schuster in providing this Website. Both companies are “controllers” of the personal data collected through this Website, as defined in applicable data protection laws.

3. What is personal data?

Personal data is any information related to an identifiable person (a person who can be identified directly or in connection with other information we hold). For example, the following could be considered personal data: your name, address, phone number, date of birth, email address, and related information such as registering for a newsletter or entering a competition. 

 

4. Information that may be collected about you

  • When you register to receive email newsletters or alerts or enter a competition on our Website you will be asked to provide certain information about yourself which may include your name, email, gender and phone number;
  • If you are under 16, you may not submit any information about yourself without the permission of a parent or guardian.
  • If you contact us via the Website, for example by sending an email to privacyadministrator@simonandschuster.com, we may keep a record of that email or comment;
  • We may collect details of your visits to our Website including, but not limited to, IP address, traffic data, location data and other communication data and the areas of the Website that you access. Please see section 8 below for further details.

Note that registration with the Website is entirely voluntary, however you will be unable to access or use certain parts of the Website if you are not a registered user.

 

5. How will we use your information?

We may use your personal data for these purposes:

  • operate and administer the Website and allow you to participate in the interactive features of the Website (where you choose to do so) for example by running competitions and notifying winners;

We do not share your personal data with third parties except as set out in this policy.

We may disclose to, and share your information with, third parties in the following circumstances:

  • where you wish to use the "Email a friend" function on the Website, we will disclose your identity to the recipient of the email message;
  • we may disclose your personal data to any company within the Simon & Schuster group of companies, including Simon & Schuster, Inc. in the United States (see www.simonandschuster.com for information about the corporate group). We use best efforts to ensure that personal data is treated confidentially within the Simon & Schuster group, and where required, we transfer personal data to affiliates outside the European Economic Area under the terms of EU-approved standard contract clauses (you may obtain further information from the contact provided below);
  • in the event that we sell or buy any business or assets, we may disclose your personal data to the prospective seller or buyer of such business or assets;
  • as Simon & Schuster is a responsible company, we may disclose your personal data in order to comply with court orders or when required to do so by law. We may also disclose such data in cooperation with a law enforcement or government request or in order to enforce or apply our Terms of Use;
  • to protect the rights, property or safety of Simon & Schuster, any company within the Simon & Schuster group of companies (including Simon & Schuster, Inc) or users of the Website;
  • to service providers who manage aspects of our operations (for example third parties who host the Website).

Please note that as Simon & Schuster Digital assists in the provision of the Website any information that is collected through the Website will be automatically transferred to the United States. In addition, please note that the information you provide to us will be held on our computers and may be accessed by our staff or by parties who help us publish the Website, provide the competitions, or perform the other functions described above, some of whom may be located in the US or elsewhere outside the European Economic Area. By submitting your personal data, you agree to this transfer, storing, or processing. Countries outside of the European Economic Area do not all have similar data protection laws, but we undertake to treat your data in accordance with this privacy policy wherever the processing takes place.

We may pass aggregate information on the use of this Website to third parties, but this will not include information which could be used to identify you.

8. Cookies, web beacons, collection of IP addresses and clickstream data

Cookies

We use cookies on our Website, these allow us to collect data which assists us in improving the Website and enhancing your experience on our Website. Cookies are electronic tags that contain small amounts of information which are placed on your computer in the process of sending your computer a file, such as a web page. A cookie is a unique identifier that tells a website when a computer that has previously visited the website returns and what pages it requests on each of its visits. IP addresses and clickstream data

Our server automatically collects data about your internet address when you visit us. This information, known as an Internet Protocol address, or IP Address, is a number that is automatically assigned to your computer by your internet service provider whenever you are on the internet. When you request pages from our Website, our servers may log your IP Address and sometimes your domain name. Our server may also record the referring page that linked you to us (e.g., another website or a search engine); the pages you visit on this Website; the website you visit after this Website; other information about the type of web browser, computer, platform, related software and settings you are using; any search terms you have entered on this Website or a referral site; and other web usage activity and data logged by our web servers.

Please note that opting out through these mechanisms does not opt you out of being served advertising. You will continue to receive generic ads while online.

 

10. Social and Platform Integration

You may choose to participate in a social media application or similar application, skill or feature with a third party service (“Third Party Application”), through which you allow us to collect (or the third party to share) information about you, including personal information. The Third Party Application may be a feature on our Website (such as reviewing a product, logging into our Website with your credentials with a third party service, or otherwise linking the Website with another web site or interactive service).  Or, the Third Party Application may be a Pimsleur feature or Pimsleur content available through a third party web site, device or service. 

When you choose to participate, you may be opting to link your activity on our Website with that third party web site, device or service, which may then collect information about your visits to our Website and may publish that activity as you request to your profile or similar feature with that third party (such as if you choose to share an article you read on one of our Website with your connections on the third party web site).

We also may have links on our Website to our pages on a third party site, and those third parties may set cookies or web beacons on the Website, whether or not you link through to those pages. 

The information we collect is subject to this Privacy Policy. The information collected and stored by the third party remains subject to the third party’s privacy practices, including whether the third party continues to share information with us, the types of information shared, and your choices with regard to what is visible to others on that third party web site and service. The third party may allow you to remove the Third Party Application, in which case we will no longer collect information about you through it, but we may retain the information previously collected. In addition, we may receive information about you if other users of a Third Party Application give us access to their profiles and you are one of their “connections” or information about you is otherwise accessible through your “connections” web page, profile page, or similar page on a social networking or other third party web site or interactive service.

This Website contains links to or from other websites. We are not responsible for the data collection practices of any websites linked to the Website, nor does our linking constitute association with, sponsorship or endorsement of the content or practices on these websites.

Linked websites do not necessarily follow our privacy practices. We do not control cookies placed on your computer by third parties whose links appear on our Website. When visiting linked websites, you should refer to each such website's individual privacy policy.

 

12. Your Data Subject Rights

You have certain rights as a “data subject” under the GDPR or other applicable laws.  You may decline to share certain personal information with us, in which case we may not be able to provide some of the features and functionality of our Website. In accordance with applicable law, you have the right to access your Personal Data, object to or restrict further processing, rectify or erase the data, or ask for it in a portable format where feasible. Requests should be submitted using the contact instructions below.

You may make some changes yourself to the personal information collected by our account registration pages by logging into the Website and updating the account settings page. We will make commercially reasonable efforts to provide you reasonable access to your personal information within 30 days of your access request to the contact address below. We provide this access so that you may review, make corrections, or request deletion of your personal information. If we cannot honor your request within 30 days, we will inform you when we will be able to provide such access. If for some reason access is denied, we will provide an explanation as to why access is denied. When technically feasible, at your request, we will provide your personal data to you or transmit it directly to another controller.

The Website is for general audiences, and is not intended for use by anyone younger than the age of 16.  We do not knowingly collect personal information from individuals younger than age of 16.
